Mr. Greville Janner

asked the Secretary of State for the Environment (1) what procedures exist under which MOT test centres may appeal against disqualification;

(2) whether he will extend the appeals procedures available to MOT test centres which are disqualified.

An authorised examiner has a statutory right to appeal to my right hon. Friend against the withdrawal of his authorisation to conduct MOT tests. Appeals may be made within 14 days of the notice of withdrawal; before the notice is issued, the examiner is given the opportunity to make representations to the senior area mechanical engineer of the Department of the Environment on the proposal to withdraw authorisation. These arrangements ensure that full and careful consideration is given to all aspects of a particular case.

asked the Secretary of State for the Environment whether examiners of the Department of the Environment are insured to drive MOT test cars on the road.

Vehicle examiners of the Department of the Environment and authorised examiners are required by law to have insurance cover or security for third party risks when driving on a public road a car undergoing the MOT test.
