Mr. Whitehead

asked the Secretary of State for the Environment what representations he has received concerning the alteration of endorsed driving licenses under the Road Traffic Act 1974.

Section 13(1) of the Road Traffic Act 1974 extended the currency of endorsement by one year so as to ensure that all relevant convictions should come to the notice of the courts when dealing with later offences. Some licence-holders have represented that this legislation changes court sentences retroactively, but in ordering endorsements the courts do not specify their duration; this is determined by the law currently governing the issue of licences when a new one is applied for. There has been no change in the periods over which endorsements count for totting-up purpose
