§ Mr. Robert Taylorasked the Secretary of State for Prices and Consumer Protection what progress is being made towards ending the practice of exclusion clauses in the contracts of private companies responsible for car-parking facilities.
Mr. Alan WilliamsIn their Second Report on Exemption Clauses, published last month, the Law Commissions recommend that provisions in such contracts excluding or restricting liability for negligence should be made void where a person

is killed or injured while making use of a car park and the liability is that of the owner or manager of the car park. The Commissions propose that other exclusions or restrictions of liability relating to the use of car parks should be subject to a test of reasonableness.
Widespread consultation on these and other proposals in the Law Commissions' report has already begun with a view to legislation in this area as soon as possible.
