asked Her Majesty's Government:

Whether, pending the completion of the review, now being conducted by the Law Commission, of treason and other offences against the State, they will instruct the Director of Public Prosecutions to exercise the greatest possible restraint in bringing prosecutions under the Incitement to Disaffection Act 1934.

This is a matter for my right honourable friend the Attorney General. It is usual for the Attorney General to be consulted by the Director of Public Prosecutions concerning any possible prosecution under the Incitement to Disaffection Act 1934, and very careful consideration is given to the merits of each case in deciding whether proceedings are justified.
