§ Miss Richardsonasked the Attorney-General whether, pending a decision to repeal the Incitement to Disaffection Act, he will undertake to have discussions with the Director of Public Prosecutions with a view to ensuring that no further prosecution take place under this Act.
§ The Attorney-GeneralNo. It would not be constitutionally proper to require the prosecuting authorities to treat as repealed an Act of Parliament which Parliament has not repealed. The policy of the Director of Public Prosecutions will continue to be, in this and other contexts, to give very careful consideration to the merits of individual cases in deciding whether proceedings are justified; in cases of difficulty it is his practice to consult the Law Officers.
