Mr. Robert Taylor

asked the Secretary of State for Trade whether the attention of the Director of Public Prosecutions has been drawn to the false invoices disclosed in paragraph 207 of his Department's report into the affairs of Bernard Russell Limited.

Mr. Clinton Davis

This matter was reported at an early stage of the Inspector's enquiries and was referred to the Director of Public Prosecutions. I would also refer the hon. Member to the answer I gave on 3rd December 1975 to my hon. Friend the Member for Stoke-on-Trent, Central (Mr. Cant).

asked the Secretary of State for Trade whether the liquidator

of Bernard Russell Limited has recovered the illegal directors' advances disclosed in paragraph 136 of the report of his Department into the affairs of the company; and if not what steps are being taken to do so.

Mr. Clinton Davis

The joint voluntary liquidators, on the advice of solicitors and counsel and with the consent of their Committee of Inspection, recovered £1,000 in a compromise settlement in respect of this matter.

Mr. Robert Taylor

asked the Secretary of State for Trade whether it is his intention to introduce legislation to strengthen section 190 of the Companies Act 1948 in accordance with the recommendation contained in paragraph 271(c) of his department's report into the affairs of Bernard Russell Limited.

This is a matter which will be considered in the ongoing review of company law.
