asked Her Majesty's Government:

To what extent the Parliamentary Commissioner Act 1967 applies to administrative action taken on behalf of the Crown consequential on British membership of the EEC; in particular to action taken in

  1. (a) implementing EEC directives, regulations and decisions;
  2. (b) carrying out decisions of the Management Committees of the Commission;
  3. 1229
  4. (c) making applications to, and distributions from, the Social Fund.

LORD SHEPHERD

The Parliamentary Commissioner Act 1967 provides for the investigation of administrative action by Government Departments and other authorities listed in Schedule 2 to the Act irrespective of the authority under which the actions were taken. Thus the Commissioner's powers to investigate action taken in consequence of British membership of the European Communities are the same as his powers to investigate other administrative action taken by those authorities.
