Mr. John Evans

asked the Secretary of State for the Home Department what daily expenses are magistrates allowed to claim under (a) loss of earnings, (b) attendance allowance, (c) subsistence allowance and (d) car allowance.

Lay magistrates may claim up to £5.50 a day for loss of earnings or other financial loss but not an attendance allowance. They may claim subsistence allowance of up to £4.05 a day and, where the use of a private car results in a substantial saving of time or is otherwise reasonable, a car allowance of from 6.4p a mile to 7.8p a mile according to the cubic capacity of the car engine. These rates, which are prescribed in the Justices' Allowances Regulations, are related to allowances payable to other persons giving voluntary public service and are varied from time to time as necessary.
