§ Mr. Trotterasked the Secretary of State for the Environment on what date surcharges were imposed by the district auditor on members of the former Clay Cross Council, what was the total amount of the surcharge; and what action has been taken to recover the amount of the surcharge.
§ Mr. CroslandA surcharge of £6,985 was imposed on 17th January 1973. There was an appeal to the High Court which was finally disposed of on 28th September 1973. This was followed by an originating summons against the Secretary of State which was dismissed on 31st January 1974. The district auditor issued a writ for recovery of the surcharge in May and is, I understand, now seeking a judgment summons.
