Mr. Meacher

asked the Secretary of State for the Environment how many times since 1963 Section 99 of the Public Health Act 1936 has been used to ensure, in the case of houses unfit for human habitation and subject to a compulsory purchase order, that a local authority requires that such premises are kept in a reasonable condition as long as they remain occupied; and what action he proposes to take to ensure that local authorities fully carry out their mandatory duty under this section.

This information is not available. Under Section 99 a magistrates' court may direct an authority to abate a nuisance. No action on my part is necessary to ensure that a local authority complies with a court order to which it is subject.
