HC Deb 04 July 1973 vol 859 c142W
Mr. Ashley

asked the Secretary of State for the Home Department if he will introduce legislation to ensure that, while a legal parental dispute continues, the children cannot be taken away by a parent unless he has been awarded legal custody.

Mr. Carlisle

I am not sure what the hon. Member has in mind. Under existing law the father has custody, and under the Guardianship Bill both parents will have equal rights of custody, unless and until a court orders otherwise.
