asked Her Majesty's Government:

What they plan to do about Section 30(1) of the Immigration Act 1971, since it appears to be incompatible with the practices of the E.E.C.

THE MINISTER OF STATE, HOME OFFICE (VISCOUNT COLVILLE OF CULROSS)

The Government do not accept that Section 30(1) of the Immigration Act 1971 is incompatible with E.E.C. practices. Action is initiated only on a specific request from the doctor in charge of the patient, and before authorising repatriation under the section the Secretary of State has to be satisfied that this is in the interests of the patient.
