asked the Secretary of State for the Environment if he will refuse to grant planning approval to any proposal to quarry in areas where colliery waste is readily available, for any materials for which colliery waste can provide an acceptable alternative.

The determination of such applications is the duty of local planning authorities. The local availability and cost of suitable alternative waste materials is a factor which should be taken into account in appropriate cases.
