Whether in their opinion it would be constitutionally permissible for a member of the Roman Catholic or Jewish faith to occupy the Woolsack.

There is some doubt whether the legislation which abolished disabilities on Roman Catholics extends to the office of Lord Chancellor; but the Government are not aware of any statutory provision which prevents a member of the Jewish faith from being appointed to that Office:
