Mr. Abse

asked the Secretary of State for the Home Department what steps he proposes to take to study the implications of the recent divorce court legislation for the matrimonial jurisdiction of the magistrates' courts.

Mr. Maudling

I have invited the Law Commission to consider:

  1. (a) what changes in the matrimonial law administered by magistrates' court may be desirable as a result of the coming into operation of the Divorce Reform Act 1969 and the Matrimonial Proceedings and Property Act, 1970, and
  2. (b) any other changes that may appear to be called for in related legislation in order to avoid the creation of anomalies.
The Law Commission has set up a Working Party under the chairmanship of Mr. Justice Scarman, comprising representatives of the Commission and the Home Office, to consider this matter and to formulate proposals for any legislation that may prove necessary.
