Under the terms of Section 39 of the Copyright Act, 1956, all literary works made or first published by or under the direction or control of Her Majesty or a Government Department are the subject of Crown copyright. The degree to which Government financing or part-financing of any particular research project brings it within the scope of Crown copyright depends on the circumstances of the case. The Crown can and does relax or waive its rights in appropriate cases.
