Mr. Weitzman

asked the Attorney-General whether, having regard to the recent decision in Lewis v. Avery, he will consider legislation to enable the courts to apportion loss between victims of fraud or refer the matter to the Law Commission.

The Attorney-General

There are no plans for amending this branch of the law. The Law Reform Committee considered that it was not practicable to introduce any system of apportioning the loss between persons who are the victims of theft, fraud or mistake affecting the transfer of a chattel. I will, however, study the full report of the decision in Lewisv. Avery as soon as it is available.
