asked the Secretary of State for Scotland whether he will ask the Scottish Law Commission to examine measures for the recovery of fines during its inquiry into civil diligence.

Yes. If more effective measures can be devised for the recovery of civil debt, it is appropriate that they should be available for the recovery of fines; and the Lord Advocate and I have asked the Scottish Law Commission to have regard to fines in its inquiry. We have also considered in this context the question of reparation by the offender. The underlying problem there is the extent to which the victim can, in fact, recover what is already due to him by civil law, and the Commission's attention has been directed to the desirability of its examining this aspect of its remit.
