Mr. David Howell

asked the Minister of Transport whether, in the light of recent court cases concerning drivers asleep in their vehicles on the hard shoulders of motorways, he will take steps to redefine the conditions constituting an emergency situation justifying parking on motorways.

Mr. Murray:

The Motorway Traffic Regulations allow a driver to stop on the hard shoulders in emergencies. Drowsiness is unlikely to constitute an emergency because the driver must be aware of its onset and should take the earliest opportunity to leave the motorway.
