Mr. Michael McNair-Wilson

asked the Minister of Housing and Local Government whether he will take steps to repeal Section 15 of the Public Health Act, 1936, in view of the fact that it refuses a right of appeal to a private citizen against a public body wishing to lay mains.

Mr. Denis Howell:

These and comparable powers, for local authorities to lay public sewers and water mains through private land after giving reasonable notice to owners and occupiers, have existed for nearly a century, and I have no reason to believe that they operate unfairly as between the individual and his fellow citizens.
