§ 45. Mr. Roseasked the President of the Board of Trade whether, in view of the fact that the Association of British Travel Agents is primarily a trade association, he will take steps to set up an independent travel council to consider complaints against holiday tour operators.
§ Mrs. Gwyneth DunwoodyWe do not consider there is sufficient evidence of a need for a body of this kind. The number of complaints against tour operators is very small compared with the number of holidays taken by United Kingdom residents.
§ 46. Mr. Roseasked the President of the Board of Trade whether he is aware that most tour operators provide no legal redress and some tour operators refuse ex gratia redress in respect of legitimate and proven failure of or inadequacy of services provided under contracts entered into with clients in this country; and if he will take steps to deal with this problem.
§ Mr. Roseasked the President of the Board of Trade if he will introduce legislation to ensure that conditions in contracts between travel agents or tour operators and the public purporting to avoid liability in respect of what would otherwise be breaches of contract in respect of accommodation, service and travel, are rendered void.

§ Mrs. Gwyneth DunwoodyExclusion of liability in contracts for services is a complicated issue, on which we must await the advice of the Law Commissions before contemplating action.
