104. Mr. W. T. Williams

asked the Attorney-General if he will seek powers to enable victims of road accidents to obtain compensation when the accident is caused by a latent defect in the vehicle causing the accident.

The Attorney-General

The injured person is not necessarily without remedy at present in the case of an accident caused by a latent defect in a vehicle and the onus resting upon those relying on the defence of latent defect is a heavy one. Any change in the basis of the motorist's liability would need careful consideration.
