If the Minister is minded to reach a decision contrary to the Inspector's recommendations, the advice of the Investigator is then conveyed to the parties concerned, any of whom may ask that the inquiry should be re-opened, in which case the advice in question would be given as evidence and could be the subject of cross-examination.
(3) The Minister may appoint an Investigator to act as an assessor to advise the Inspector on technical matters at an inquiry. This is done, under the authority of the Planning Acts, when, in the Minister's opinion, the Inspector might otherwise find difficulty in appreciating the significance of expert evidence. An assessor cannot, of course, give evidence before, during or after the inquiry.
