asked the Attorney-General (1) whether he is satisfied that all those holding gold coins contrary to Statutory Instrument 1966, No. 438, have now been prosecuted; and if he will make a statement;

(2) whether it is now the intention to prosecute anyone who hands in gold coins under Statutory Instrument 1966, No. 438.

The Attorney-General

I would refer the hon. Member to the Answer given by my hon. and learned Friend the Financial Secretary on 30th January, 1967, when he said that the Treasury is continuing for the time being the practice of not asking the Director of Public Prosecutions to consider whether to proceed against those who voluntarily disclose their holding of gold coins. The Director will consider on its merits any case in which there is evidence that a person has committed an offence. It is, in the nature of things, impossible for me to be satisfied that every offender against this, or indeed any other law, has been prosecuted.—[Vol. 740, c.19.]
