asked the Secretary of State for the Home Department what steps he proposes to take to stop the circulation of nude literature by the Penthouse firm, which recently circulated such matter by post.

It is an offence under the Obscene Publications Act, 1959, to circulate, by whatever means, material tending to deprave and corrupt those likely in all the relevant circumstances to read or see it. Whether a particular publication is obscene in this sense can be determined only by the courts, and it is for the prosecuting authorities to decide whether proceedings should be taken.
