§ Mr. Kershawasked the Minister of Transport whether he is aware that by Section 78 of the Highways Act, 1835 it is an offence to lead or ride a horse on the right hand side of the road, and that it is a widespread custom to do this, in the interests of safety, so that the horse faces on-coming traffic; if he will seek to amend the law on this matter; and whether he will make a statement.
§ Mr. Tom FraserI am advised that Section 78 of the Highways Act of 1835 should be interpreted as requiring that horses should be ridden or led on the left of the road. Should the opportunity occur I would be willing to consider revising this provision. I have no evidence, however, that road safety is being endangered by undue insistence on literal observance of this Statute.
