HC Deb 04 August 1965 vol 717 c320W
39. Mr. Hector Hughes

asked the Minister without Portfolio if he is aware that the law of treasure trove is out of date, particularly having regard to the need for widespread access to ancient treasure in an age of large population, easy transport, nation-wide education and modern tourism; and if he will take steps either to abolish it or to bring it into line with modern needs.

Sir Eric Fletcher

Although the law of treasure trove dates from the twelfth century, it meets the requirements mentioned by the hon. Member. In England and Wales treasure trove means gold or silver objects that have been hidden; whereas I understand in Scotland the Crown may claim any antiquities that are found. In practice, treasure trove of any interest is usually handed over by the Crown to the appropriate Museum for public exhibition. My noble Friend has drawn the attention of the Law Commission to this branch of the law.
