asked the Minister of Transport what information he has as to the number of prosecutions of highway authorities, prior to the enactment of the Public Health Act, 1961, for the use of vehicles in connection with the maintenance of footpaths.

59. Sir B. Janner

asked the Minister of Transport when the provisions of Section 1 of the Highways (Miscellaneous Provisions) Act, 1961, are to be brought into effect; and whether he is satisfied that the new regulations preventing the use of effective rollers for the laying down and maintenance of macadamised footpaths will not place undue difficulties in the way of highway authorities concerned about their liabilities in connection with the said Section 1.

The section will come into force on 3rd August this year. The use of vehicles on footpaths is not prevented, but legalised, by the new Regulations made under Section 49 of the Public Health Act, 1961. With a speedy procedure for granting relaxations under Regulation 7, I see no reason why highway authorities should experience undue difficulties.
