Mr. Darlingasked the President of the Board of Trade if he will introduce legislation to amend the Hire Purchase Acts without further delay, in view of the opinions of judges in the Court of Appeal, in the case of Ashley Industrial Trust v. Rollinson, in which the defendant was dispossessed of a car even though he had been misled as to the terms or a contract by a dealer.
§ Mr. D. PriceThe transcript of the judgment of the Court of Appeal in this case shows that the Court were of the opinion that the defendant was aware of the nature and extent of his obligations under the agreement, which was for hiring and not for hire purchase. It does not seem, therefore, that the defendant was dispossessed of the car as a result of a misleading statement by the dealer. No question of amending the Hire Purchase Acts seems therefore to arise from the case.
