62. Mr. Driberg

asked the Secretary of State for the Home Department if he is aware that some local authorities are having difficulty in obtaining licences for the sale of liquor in town halls and assembly halls, as provided for by the Licensing Act, 1961; and if he will introduce amending legislation to clarify the law in this respect.

The hon. Member has informed my right hon. Friend of two cases in which local authorities have been unable to obtain justices' licences, but no other such case has been brought to his notice. It is for the licensing justices to decide whether or not to grant a licence in any particular case, and the only change made by the Licensing Act, 1961 in the law governing this matter was the introduction of a right of appeal to quarter sessions against a decision of the justices My right hon Friend has no reason to think that the law needs to be clarified.
