77. Mr. J. Johnson

asked the Secretary of Slate for the Colonies for what reason some officials and members of the Nairobi People's Convention Party have been detained; whether it is proposed to bring them to trial; and if he will state what charges have been made against them.

The two men detained were held by authority of Emergency Regulation 2 (6), under which an authorised officer may arrest and detain for up to 28 days pending inquiries any person whom he reasonably suspects has acted or is about or likely to act in a manner prejudicial to public safety or the maintenance of public order. A decision whether to prosecute these men for any alleged offence is one for the Attorney-General of Kenya. The third part of the Question does not arise.
