Mr. Knox Cunningham

asked the Minister of Transport and Civil Aviation what undertakings he has received from the Shipping Federation on behalf of its members, from all the English protecting and indemnity associations, Lloyd's Underwriters, the member companies of the Institute of London Underwriters, and the Liverpool Underwriters Association, with regard to actions brought in the courts of the United Kingdom, in respect of loss of life or personal injury, in matters which fall to be determined under the Rhine Navigation Convention; and if he will state the terms of the respective undertakings.

I have received on behalf of the Shipping Federation, the English Protecting and Indemnity Associations, Lloyd's Underwriters, the member Companies of the Institute of London Underwriters and the Liverpool Underwriters Association an assurance that, in the case of a claim for death or personal injury, they would not seek the Secretary of State's certificate under Section 6 of the Administration of Justice Act, 1956, to have a claim or question determined under the provisions of the Rhine Navigation Convention, 1868, if the plaintiff was a citizen of the United Kingdom and Colonies and the ship in respect of which the claim arose was a British ship entered in or, as the case may be, insured with them.
