Mr. PhilipBell asked the Minister of Pensions and National Insurance whether, in view of the successful appeal of Albert Edward Taylor, Case List Number 14/6, to the Appeal Tribunal, Kingston, on 14th April, 1959, against the disallowance of his claim for sickness benefit, on the grounds that he had attained pensionable age and retired, or been deemed to have retired, from regular employment, he will amend accordingly paragraph 16 of Leaflet N.I.28 issued in June, 1955, and will, in the meantime, issue the necessary Departmental instructions to insurance officers.
§ Mr. Boyd-CarpenterI am informed that in this case the insurance officer has lodged an appeal to the National Insurance Commissioner against the decision of the local tribunal. The matter is, therefore,sub judice. I have, in any event, no power to issue instructions to insurance officers as to the discharge of their statutory duties.
