asked the Minister of Housing and Local Government and Minister for Welsh Affairs if he is aware that the decision in the recent case of Cater v. Essex County Council creates a difficult position for local planning authorities in regard to the enforcement of planning control; and what action he proposes to take in the matter.

Yes. I am considering in consultation with my noble Friend the Lord Chancellor whether an appropriate amendment can be made in the Town and Country Planning Bill now under consideration in another place.
