§ 102. Mr. Hector Hughesasked the Secretary of State for Scotland if he has yet ascertained how many tenants of houses in Aberdeen are affected by the Rent Act, 1957, and its amending Act; how many have been evicted from their homes; and how many are likely to be evicted.
§ Mr. MaclayAbout 400 let houses in Aberdeen rated at over £40 were decontrolled by the Rent Act, 1957. Most of the tenants of these houses will no doubt have entered into new leases with their landlords or made other arrangements for their accommodation. Any tenant who has been unable to obtain a renewal of his tenancy and who remains in the house after the expiry of a notice to quit cannot be evicted without a court order and, under the Landlord and Tenant (Temporary Provisions) Act, 1958, the sheriff can in certain circumstances postpone the execution of such an order.
Up to 4th December, two applications had been made to the court for orders for possession in respect of houses in Aberdeen to which the Act of 1958 applies. In one case, with consent of the tenant, an order for possession was granted and, in the other, proof was fixed for 15th January.
