Mr. Hector Hughes

asked the Secretary of State for Scotland what consideration he has given to the report which he called for on or before 11th March from the Aberdeen County Council relating to Dancing Cairns Quarry; what reply he will make to its conclusions; and whether, in view of the urgency of the matter, he will use his powers under the Public Health (Scotland) Act, 1897, to require the Council to fill in the quarry by bulldozers instead of by the slower method of using it as a tip.

Aberdeen County Council has reported that barbed wire entanglements have now been erected above the quarry. After careful consideration, I should not feel justified in taking action under Section 146 of the Public Health (Scotland) Act, 1897, on the grounds that these local authorities have neglected their duty.
