81. Mr. Harold Davies

asked the Secretary of State for the Colonies if he will instruct the Kenya Government to provide safe-conduct passes for witnesses required by the defence in the trial of Jomo Kenyatta and others at Kapenguria.

The Kenya Government have given every assistance to the defence to secure attendance of witnesses required by them at Kapenguria, frequently at very short notice, and will continue to do so. It cannot, however, give a binding undertaking that a witness at present outside the Colony will be immune from the process of the law if he comes within jurisdiction.
