78. Mr. R. Harris

asked the Minister of Civil Aviation if he is satisfied that Section 40 of the Civil Aviation Act, 1949, covers injury to members of the public or damage to their property caused by aircraft crashes or accidents; what representations he has received on this matter from the Local Authorities (Airport) Committee; and what reply he has sent to them.

In general, the purpose of the Section is to provide compensation for surface damage caused by aircraft, but it is for a court of law to determine its application in any particular case. An inquiry on this point was received from the Committee, and I am sending my hon. Friend a copy of the correspondence.
