43. Mr. Hastings

asked the Secretary of State for the Home Department whether he is aware that the Essex County Council have made a new by-law to permit schoolchildren over 13 years of age to undertake gainful employment at 7 a.m. on Sunday mornings; and, in view of the fact that it is undesirable for children to be employed without breakfast at this early hour winter and summer, whether he will refuse confirmation of this by-law.

Parliament has conferred on local education authorities power to make bylaws with regard to the employment of children on Sundays, and as the bylaws to which my hon. Friend refers were validly made under this power after consideration by the authority of local circumstances, I did not feel justified in refusing confirmation. I accordingly confirmed the bylaws on 8th February.
