asked the Secretary of State for Air whether, under his Regulations, an officer who has been dismissed the service by sentence of court martial forfeits his war gratuity for the period of his commissioned service, when he subsequently enlists and serves in the ranks and reaches the rank of warrant officer.

The Regulations provide that where service is terminated by dismissal, removal, retirement or resignation on grounds of misconduct, incapacity, inefficiency or for any like reason regarded as warranting premature ending of service, war gratuity, otherwise admissible in respect of commissioned service, may be withheld or reduced in amount, at the discretion of the Air Council. Any award made in exercise of such discretion will be entirelyex gratia. Where such service is followed by approved service in the ranks, i.e., service which confers entitlement to war gratuity for other rank service, such entitlement is assessed separately.
