HC Deb 22 October 1942 vol 383 c2142W
Sir H. Williams

asked the Attorney-General whether it is proposed to introduce legislation to amend the Statute of Frauds?

Sir R. Young

asked the Attorney-General whether he has been made aware of Lord Justice Mackinnon's comments in the Court of Appeal regarding the Act for the Prevention of Frauds and Perjuries passed 265 years ago; and will he take steps to repeal or, by new legislation, remove its alleged injustices and thus save the waste of expense and time resulting from the obscurity of its provisions?

The Attorney-General

The question whether legislation should be introduced to repeal the Section of the Statute of Frauds which remains outstanding and the other legislation on the same matter now on the Statute Book formed the subject of a recommendation of the Law Revision Committee, and was under consideration when the war began. War conditions caused that consideration then to be postponed. I should explain that much more is involved in the Committee's proposals than a simple repeal, but consideration of these difficult and important questions is being resumed with a view to determining whether the Report of the Committee should be opted and if so whether this is a subject with which Parliamentary time ought to be occupied in the course of the war.
