asked the Chancellor of the Exchequer whether when land forms the subject matter of a requisition, under Regulation 51 (1) of the Defence Regulations, and there is machinery and plant contained in the buildings erected thereon, the machinery and plant is considered part of the requisitioned land and included in the requisition or whether a separate and distinct notice of requisition, under Regulation 53 (1) of the Defence Regulations, is necessary for the requisitioning of such machinery and plant?

If plant and machinery are fixed to land in such a manner as in law to be part of the land, such plant and machinery can be requisitioned as part of the land under Defence Regulation 51. If the plant and machinery are not so affixed they can be requisitioned under Defence Regulation 53 and not under Defence Regulation 51.
