HC Deb 09 April 1936 vol 310 c2965W
Mr. T. SMITH

asked the Home Secretary whether he is prepared to waive the Crown privilege and so enable Burt and Lloyd to take action in the courts for wrongful dismissal in connection with the escape of a red-band prisoner at Oxford about two years ago?

Mr. LLOYD

I think the hon. Member is under some misapprehension as to the position. The terms of service of these officers, as of all other servants of the Crown, are such as to preclude them from suing the Crown for wrongful dismissal, since, in law, every Crown servant holds his office at the pleasure of the Crown, and accordingly his employment can be terminated at any time without notice.
