§ Major HILLSasked the Minister of Agriculture whether he is aware that one of the terms of an agreement entered into on 21st November, 1927, between the Commissioners of Crown Lands, the London County Council, the Kensington Borough Council, and Messrs. John Barker and Company, Limited, was that Ball Street should not be built upon until a loading dock had been constructed on the west side of King Street to the Commissioners' satisfaction; that although the dock has not been completed Ball Street has already been partially built upon; whether the consent of the Commissioners to this building was given or sought; and, if not, whether, in view of the fact that it was on the strength of this agreement that the householders of Kensington Square withdrew their opposition to the closing of Ball Street, the Commissioners of Crown Lands propose to take any action to enforce the terms of the agreement?
Mr. BUXTONThe arrangement embodied in the agreement is as stated by the hon. Member. The consent of the Commissioners of Crown Lands to the new building on the site of Ball Street was not given or asked for before the erection of the building; and immediately on the matter being brought to their notice, they drew the attention of Messrs. Barker and Company to the breach of contract. They have also drawn the attention of the London County Council and the Kensington Borough Council to the matter and are awaiting further communications from those bodies on the subject.
