§ Major POLEasked the Under-Secretary of State for the Colonies what decision has been arrived at in regard to the legality of the proposal of the Commissioner to restrict sales of residential plots in Mombasa to Europeans; and, in view of this decision, what course the Government propose to take?
§ Mr. LUNNI have seen a Press report of a recent judgment by the East African Appeal Court to the effect that the Government of Kenya is not empowered to restrict the sale of the plots in question to Europeans, but that residential restrictions are within the Government's powers. Pending the receipt of the full judgment and of the views of the Colonial Government, I am not in a position to make any statement in the matter, especially as I understand that there is a possibility of further legal proceedings.
