asked the Minister of Health whether he is aware that questions have been raised as to whether common or Lammas rights exist in respect of a field known as Basing field, at Thames Ditton; and whether he will take steps to prevent building upon such field pending an inquiry as to whether such rights are still subsisting?

This matter has come under my notice in connection with a proposed town planning scheme for the district. I have no authority to prevent building on land, because it may be subject to common or Lammas rights. I am advised that the fact that a person has obtained, in connection with a proposed town planning scheme, permission to develop land would not entitle him to infringe any rights of common which might exist on the land or in any way affect the legal position of the owners of such rights.
