§ Mr. FORRESTasked the Minister of Health whether he has received a suggestion that an Order should be made for all mosquito-infested ponds and stagnant waters to be deemed a common nuisance and that they should be subject to the jurisdiction of the local authority; and, if so, what action he is taking in the matter?
Mr. CHAMBERLAINI have received such a suggestion, but I have no power to make such an Order. Under Section 91 of the Public Health Act, 1875, any pool, ditch, etc., in such a state as to be a nuisance or injurious to health is to be deemed a nuisance liable to be dealt with under the Act. The question whether in any particular case a pond is a nuisance is one of fact to be determined by the Court in any proceedings instituted by the local authority under the section.
