HC Deb 04 February 1926 vol 191 cc336-7W
Mr. DUCKWORTH

asked the President of the Board of Trade whether he is aware of the difficulties which have arisen as a result of the granting of registration, for use on artificial silk goods, of trade marks which are almost identical with marks already registered for use or: cotton piece goods or yarns; and whether any and, if so, what stops are being taken to remove the: consequent complications?

Sir P. CUNLIFFE-LISTER

It is possible that certain marks have been registered in respect of artificial silk goods which may conflict with marks already registered for cotton piece goods, but before registration all marks are advertised and are open to opposition. Consequently, any owner of a cotton mark is entitled to give notice of opposition to the registration of any mark which in his opinion conflicts with his rights. Further, at any time after registration application may be made to the Registrar or the Court for the cancellation of the registration of any such mark. I may add that in no case where opposition has been entered has any mark for artificial silk goods been registered.
