§ Mr. GROVESasked the Minister of Pensions whether he will investigate the 1766W circumstances attending the refusal of hearing to the case of Mr. T. C. Folley, 140, Henniker Road, Stratford, E., at the pensions appeal tribunal, on the 24th July, 1924, although the man personally attended and was represented by the British Legion and his local Member of Parliament; whether he is aware that, although the case was not heard, the man has been informed that his appeal is dismissed; and whether he will therefore expedite the re-boarding of this pensioner?
The ATTORNEY-GENERALI have been asked to reply. I am informed that in this case the Ministry of Pensions took the preliminary objection that the appeal had not been entered within the statutory time. The Tribunal, after considering the objection and hearing the appellant, decided that the objection must be upheld, and therefore had no alternative but to dismiss the appeal on the ground that they had no jurisdiction to hear it. A decision in the following form was for warded to the appellant
Appeal dismissed. As this appeal was not entered within the statutory time, the Tribunal have no jurisdiction to deal with it.
