§ Mr. PETOasked the Secretary of State for the Home Department whether his attention has been called to the fact that in the trial of Mary Ann Nash, recently convicted of murder and now undergoing imprisonment for life, the Public Prosecutor refused to produce an official report or reports in writing in the possession of Superintendent Mackie; and whether he has seen this report, and, if not, whether he will investigate it, as the defence regarded it as most material to their case?
§ Mr. CHURCHILLI am informed that the Director of Public Prosecutions did not refuse to produce the report in question. He informed the prisoner's solicitor that the report and the officer who made it would be in court at the trial so that, subject to the judge's directions, it might be produced in evidence. Counsel for the defence neither called for its production nor made any reference to it at the trial. The material part of the report was embodied in a circular issued by the police in 1908, which circular was produced by the prosecution and made one of the exhibits in the case.
